Terms of service

These Terms of Service ("Terms") govern your use of streetwiseparts.com (the "Site") and your purchases from Streetwise LLC, doing business as Streetwise and Streetwise Motorsports ("Streetwise," "we," "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.

1. Who can buy

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree to give us current, complete and accurate order, shipping and contact information. You may not use the Site for any unlawful purpose.

2. Where we sell

We sell and ship to addresses in the United States. We do not accept orders for delivery outside the United States, except by direct email arrangement with us that includes a deposit. See our Shipping page.

3. Orders and acceptance

An order confirmation email means we received your order. It does not mean we accepted it. We accept your order when we ship it or tell you it is ready. We may refuse or cancel any order, or limit quantities, for any reason, including suspected fraud, pricing or listing errors, stock problems, or orders that appear to be placed by resellers. If we cancel an order after you have paid, we will refund the amount you paid for the canceled items.

4. Prices, payment and taxes

Prices are in US dollars and can change without notice. Your price is the price shown when you place your order. If a product is listed at the wrong price because of an error, we may cancel the order and refund you, or contact you to confirm the correct price. Payment is due at checkout. Applicable sales tax is added at checkout. Shipping charges are calculated at checkout from the weight, size and destination of your order. Orders over 100 lb are quoted separately by email.

If you have a problem with a charge, please contact us first so we can fix it.

5. Availability, special orders and drop-shipping

Some items are special order, made to order, or ship directly from a supplier's warehouse. Availability and lead times can change after you order. If an item is delayed or unavailable, we will email you and you can wait or cancel that item. Special-order items may carry a cancellation fee once ordered from the manufacturer, as described in our Return & Refund Policy. An order with several items may arrive in more than one package.

6. Shipping, risk of loss and fire system bottles

Shipping is described on our Shipping page. Charged fire system bottles ship by ground service only, both to us and from us. They cannot be shipped by air. Please inspect your package when it arrives and report damage or missing items as described on the Shipping page and in our Return & Refund Policy.

7. Returns, refunds and warranty

Returns and refunds are governed by our Return & Refund Policy, which is part of these Terms. Many products we sell carry a manufacturer's warranty. Warranty claims follow that manufacturer's terms and process, and we will help you start a claim. Except as stated in the manufacturer's warranty or in writing by us, products are sold without any warranty from Streetwise beyond what the law requires.

8. Fitment and product information

You are responsible for choosing the right part for your vehicle and your use. Fitment notes, specifications, photos and descriptions come from manufacturers and suppliers and from us, and they can contain errors or change. Check fitment before you order, and contact us if you are unsure. We are not responsible for an incorrect selection. Colors on your screen may differ from the product.

9. Racing, off-road and safety products

Many of our products are made for competition, off-road or closed-course use, and some may not be legal for use on public roads in your state. You are responsible for knowing and following the laws and event rules that apply to you, including sanctioning body rules for safety equipment.

Safety equipment, including fire systems, harnesses, seats, helmets, cages and related parts, only works when it is selected, installed, maintained, inspected and replaced correctly and on schedule. Follow the manufacturer's instructions and expiration and service intervals. Have installation done by someone qualified. We do not guarantee that any product will prevent injury, fire or damage. Motorsports and off-road driving are dangerous, and you accept the risks that come with them.

10. Services

This section applies if you hire us for work such as race car preparation, suspension work, shock service, tuning, dyno time or fire system service. We service only SPA Technique and Protrust Solutions fire systems. Quotes, scope, schedule and payment terms are agreed with you in writing, including by email, before work starts. Parts you send us for service must be sent as we instruct. We are not responsible for pre-existing conditions, or for worn, damaged or incorrectly installed parts that were not part of the agreed work. Service work is not returnable.

11. Product warnings

Some products can expose you to chemicals that the State of California lists as causing cancer or reproductive harm. See www.P65Warnings.ca.gov. State-specific warnings are shown on product pages where they apply.

12. Intellectual property

The Site and its content, including text, photos, logos, the Streetwise and STREETWISE name and marks, and designs, belong to Streetwise or our licensors and are protected by law. Manufacturer names, logos and images belong to their owners. You may not copy, scrape, resell or reuse Site content without our written permission, except for personal, non-commercial use.

13. Your submissions

If you send us comments, reviews, photos or other material, you give us a non-exclusive, royalty-free right to use, edit, publish and distribute it in connection with our business. You promise that you have the right to share it and that it does not violate anyone's rights or the law. We may remove content for any reason.

14. Prohibited uses

You may not use the Site to break any law; infringe anyone's rights; submit false or misleading information; upload malicious code; harass or threaten anyone; scrape, crawl or collect personal information about others; or interfere with the Site's security or operation. We may refuse service and block access for any violation.

15. Third-party sites and tools

The Site links to and uses third-party sites, tools and services, including Shopify, payment processors, shipping carriers and social media sites. We do not control them and are not responsible for their content, products or practices. Their terms and privacy policies apply when you use them.

17. Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent the law allows, we make no promise that the Site will be uninterrupted, secure or error-free, and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, except as the law does not allow us to disclaim and except for a manufacturer's written warranty on a product.

18. Limitation of liability

To the fullest extent the law allows, Streetwise and its owners, members, contractors and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost race entries or event costs, towing, downtime or lost data, arising from your use of the Site or any product or service. Our total liability for any claim relating to an order is limited to the amount you paid us for that order. Nothing in these Terms limits liability that cannot legally be limited, including liability for our own fraud, gross negligence or willful misconduct. Some states do not allow certain limits, so some of these limits may not apply to you.

19. Indemnification

You agree to defend and hold Streetwise harmless from third-party claims, losses and reasonable attorneys' fees arising from your breach of these Terms, your violation of law, or your misuse or improper installation of a product, to the extent the law allows.

20. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing a claim, please contact us at sales@streetwiseparts.com so we can try to resolve it. Any lawsuit must be filed in the state or federal courts located in Orange County, California, and you agree to their jurisdiction, except that either of us may bring a claim in small claims court.

21. Changes to the Site and these Terms

We may change the Site, products, prices and these Terms at any time. Changes take effect when posted here, with a new "Last updated" date. An order is governed by the Terms in effect when you placed it. Continuing to use the Site after a change means you accept it.

22. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver. These Terms, together with our Return & Refund Policy, Shipping page and Privacy Policy, are our entire agreement with you about the Site and your orders. You may not transfer your rights under these Terms. We may transfer ours, including to a buyer of our business.
